Welcome to the website of 4TEC Precision Imaging Co. DBA: 4tecdirect.com. This document is a legal agreement between you and 4TEC Precision Imaging Co. It governs your purchase and use of our professional commercial audio, video, and control equipment. By using our website or buying our products, you agree to these terms. Our principal place of business is located at 21827 R and R Road, Bay 16, Gretna, NE 68028.1. Eligibility and Account Registration

  • Commercial Use Only: Our equipment is designed for professional applications. You confirm that you are purchasing items for business, trade, or professional use, not personal consumer use.
  • Account Security: You must provide accurate information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2. Orders, Pricing, and Payments

  • Order Acceptance: All orders are subject to our acceptance. We reserve the right to refuse or cancel any order at any time for reasons including product availability, pricing errors, or suspected fraud.
  • Pricing and Taxes: All prices are listed in USD unless stated otherwise. Prices exclude shipping, handling, duties, and applicable sales or use taxes, which will be added at checkout.
  • Payment Terms: Payment must be received in full before an order is processed or shipped. We accept approved credit cards, wire transfers, and authorized corporate purchase orders.

3. Shipping, Delivery, and Freight

  • Shipping Estimates: Delivery dates are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, or supply chain disruptions.
  • Freight Shipping: For heavy commercial gear, racks, and oversized items, we offer freight shipping options. You are responsible for providing a valid delivery environment, including loading docks or liftgate requirements if applicable.
  • Risk of Loss: All shipments are made FOB (Free on Board) shipping point. Risk of loss and title transfer to you once we deliver the equipment to the carrier or freight company. You are responsible for filing claims with the carrier for damaged shipments.

4. Professional Equipment Disclaimer and Licensing

  • Technical Integration: Commercial audio, video, and control gear requires professional installation and configuration. You assume all responsibility for proper installation, system integration, and compatibility.
  • EULA Requirement: Control systems, software, and digital gear require your agreement to an End-User License Agreement (EULA). Your use of such software is strictly governed by its respective EULA, and reverse engineering or unauthorized modifications are prohibited.

5. Warranties and Technical Support

  • Manufacturer Warranties: We pass through all standard manufacturer warranties to you. We do not provide additional independent product warranties unless explicitly purchased as an extended service agreement.
  • Disclaimer: To the maximum extent permitted by law, we provide all products "as is" and disclaim all implied warranties, including merchantability and fitness for a particular purpose.

6. Returns, Windows, and Fees

  • Electronic Items: All sales of electronic items are final. We do not accept returns or exchanges on any electronic equipment.
  • Non-Electronic Items (Unopened): Unopened items may be returned within 30 days of purchase.
  • Non-Electronic Items (Opened): Opened items must be returned within 15 days of purchase.
  • Return and Restocking Fees: Approved returns are subject to a restocking fee of up to 40% of the purchase price. All shipping and freight costs are completely non-refundable.

7. Limitation of Liability

  • Damages Cap: Our total liability for any claim arising out of your purchase or use of the equipment will not exceed the total amount you paid to 4TEC Precision Imaging Co. for the specific product causing the dispute.
  • Consequential Damages: We are not liable for any indirect, incidental, punitive, or consequential damages. This includes lost profits, project delays, facility downtime, or data loss.

8. Governing Law and Dispute Resolution

  • Jurisdiction: These terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles.
  • Arbitration: Any dispute arising from these terms or your purchase will be resolved through binding commercial arbitration in Sarpy County, Nebraska, rather than in court.
